Vehicle rental agreements between a business and a consumer: what they must contain
Flotly Team - published 11 September 2026 · 8 min read
The sections that a vehicle rental agreement between a professional rental company and a private customer contains in practice: parties, vehicle, duration, price, security deposit, insurance, condition report, return. General information, to be checked with your legal adviser.
A vehicle rental agreement between a professional rental company and a private customer sets out, in practice: the parties and the driver, the vehicle, the pick-up and return dates, places and times, the price and what it includes, the security deposit and the conditions for retaining it, the insurance and the excess, the conditions of use, the procedure in case of an accident or a fine, the return arrangements, the applicable charges, and the attached condition report. Both parties sign it and the renter receives a copy.
This article goes through each section and what it needs to make clear. It is general information about rental practice in France, not a legal template: the content of your agreements and of your general rental terms must be checked by your legal adviser.
1. The parties and the driver
The rental company: company name, address, trade and companies register number, contact details. The renter: name, address, date of birth, identity document, driving licence number and date of issue. If a second driver is authorised, they appear on the agreement with the same information. An undeclared driver is a classic reason for an insurer to refuse cover, so this section must leave no room for doubt.
2. The vehicle
Registration number, make, model, rate category, mileage at pick-up, fuel or charge level, equipment handed over (keys, accessories). These details refer to the pick-up condition report, which is attached to the agreement or explicitly linked to it. The full grid is in our condition report checklist.
3. Duration and locations
Pick-up date and time, planned return date and time, pick-up branch and return branch if they differ. The agreement states what happens in case of an early return (refund of unused days or not) and a late return (any grace period, the price of an extra day, and from when the vehicle is considered not returned).
4. The price and what it includes
- Base rate and unit (day, week, package), options chosen (child seat, second driver, excess reduction), taxes.
- Included mileage and the price per extra kilometre, where applicable.
- Fuel or charging policy: returned at the same level, or the shortfall charged at a stated rate.
- Charges announced in advance: cleaning if the vehicle comes back dirty, fine handling fees, late return fees.
- Amount paid at booking (advance payment) and the balance, with the accepted payment methods.
A price that is hard to understand when signing becomes a dispute when paying. Every line that may be charged at return must be readable in the agreement before pick-up.
5. The security deposit
Amount, form (card pre-authorisation hold, or a charge), what it covers (damage not covered by the insurance up to the excess, missing fuel, listed charges), the conditions and proof required for a deduction, and the time frame and method of release. A deposit with written rules is a deposit that rarely gets argued about at return. The step-by-step mechanism is described in rental security deposits: pre-authorisation, capture, release.
6. Insurance and the excess
The agreement states which insurance covers the vehicle during the rental, what is covered, what is excluded, the excess the renter remains liable for, and the excess reduction options offered. Common exclusions (undeclared driver, driving under the influence of alcohol, use outside the authorised territory, negligence) must be visible, not buried in a dense paragraph.
7. Conditions of use
- Authorised drivers, minimum age and minimum number of years holding a licence.
- Authorised territory and prohibitions (subletting, carrying passengers or goods for payment, racing, towing, driving lessons).
- Routine care during the rental (fluid levels, tyre pressure, what to do if a warning light comes on).
- No smoking or no pets, if you apply these rules, with the corresponding charges.
8. Accident, breakdown, fine: the procedure
What to do after an accident (joint accident report, notifying the rental company within a stated time), a breakdown (assistance number, who decides on recovery) or a theft (police report, returning the keys). For traffic offences, the agreement reminds the renter that the rental company will give the driver’s identity to the authorities, and states the handling fees applied.
9. Return
Place, opening hours, what is expected of the vehicle (fuel level, cleanliness), the joint return inspection, and the consequences of a return when the rental company is not present (keys left in a drop box: the return inspection is then carried out without the renter, which must be planned for and accepted). Matching the pick-up report with the return report is what makes a damage charge defensible.
10. Personal data and general terms
The agreement, or the general terms it refers to, tells the renter how their data is used (managing the agreement, legal obligations, retention period, rights). It also states the governing law, the competent court or the consumer mediation scheme a private customer can turn to, and refers to the general rental terms accepted. These clauses follow precise regulations: this is the part to have reviewed by a legal professional first.
11. Signature and handover
The agreement is signed by the rental company and the renter, on paper or on screen, and a copy is given to the renter. In Flotly, the PDF rental agreement is generated automatically from the booking, signed on screen by the customer and filed with the condition report. The text of your general terms stays yours: the software formats and stores it, it doesn’t write your clauses for you. To start from a base, a free rental agreement template is available in our tools: adapt it, then have it checked.
Frequently asked questions
Does a vehicle rental agreement have to be in writing?
In practice, yes: it is the document that sets the price, the duration, the security deposit and each party’s responsibilities, and it is the one you produce in a disagreement. The exact requirements of form and content should be confirmed with your legal adviser.
Is the condition report part of the agreement?
It is attached to it or explicitly linked to it, under the same file number. A condition report with no link to the agreement can be challenged separately.
Can the agreement be signed on a tablet or a phone?
On-screen signatures are commonly used in vehicle rental. Their weight depends on the method used and on the context; for high-stakes agreements, ask for advice on the appropriate level of signature.
Do you need general rental terms in addition to the agreement?
Most rental companies separate the agreement (the details of the rental) from the general terms (the rules common to all rentals). The agreement then refers to the general terms, which are provided and accepted before pick-up.
Does Flotly provide a rental agreement template?
Flotly generates the PDF agreement from the booking and has it signed on screen. A free agreement template is also available in our tools, to adapt and have checked by your legal adviser before use.
